Learned counsel for the respondent/ landlord appearing through video conferencing submits that pursuant to the order dated 17.09.2025 passed by this Court, the respondent/ landlord has received the vacant, peaceful and physical possession of the subject premises. 2.

Considering the aforesaid, learned counsel for the respondent/ landlord submits that he shall not press for the user and occupation charges fixed vide aforesaid order dated 17.09.2025. 5.

As such, in view of the judgment passed by the Hon'ble Supreme Court in N.C. Daga vs. Inder Mohan Singh Rana [2003(1) SCC 453] and Vinod Kumar Verma vs. Manmohan Verma & Anr. [Civil Appeal Nos.5220-5221 of 2008, order dated 19.08.2008], the present petition has become infructuous as there is nothing remaining therein. 3.
