O R D E R

The present petition under Section 9 of the Arbitration and Conciliation Act, 1996 was filed by the petitioner in emergent circumstances seeking urgent interim orders from this Court. 2.

The controversy between the parties has been set out in the order dated 09.10.2024 passed by this Court. The operative portion of the said order reads as under:

"21. Considering the aforesaid aspects on a prima facie conspectus, it is directed that till the next date of hearing there shall be a stay of (i) the communication dated 05.10.2024 of the Apex Council filed as Document-1 alongwith the petition and (ii) the communication dated 23.09.2024 of the ETC. Further, the points tally will be worked out accordingly, and future fixtures/ matches shall be fixed accordingly. Needless to say, the aforesaid directions shall be subject to further order/s in the present petition."

Learned counsel for the petitoner submits that the aforesaid directions have been complied with and the future fixtures/matches in respect of the concerned Cricket League (Legends League Cricket) were held accordingly. All the fixtures are stated to have culminated and there are no more matches to be held in the current season. The result/outcome of the league season has also been announced.

There is no appearance on behalf of the respondent today. Even on previous date of hearing i.e. 15.10.2024, while initially somebody appeared for the respondents, none appeared for the respondent after passover. 6.

The emergent situation which impelled the petitioner to file the present petition has been obviated on account of the interim order passed by this Court. The said interim order has worked itself out and consequently, the grievance of the petitioner does not survive. As such, no further orders are required to be passed in the present petition. 7.

The present petition is, accordingly, disposed of. Needless to say, the petitioner shall be at liberty to take steps to initiate arbitration in terms of the Dispute Resolution Clause contained in the Franchise Agreement between the parties and take steps for constitution of an arbitral tribunal in terms thereof.
