The writ petitioner is aggrieved by the action of the respondents who have taken coercive action against his vending site and have also undertaken a demolition and removal drive.

From the record it is apparent that the petitioner does hold a Vending Certificate granted by the competent authority. From the record that has been placed for our perusal as well as the submissions addressed on behalf of the Delhi Police, we find ourselves unconvinced that any permanent or semi-permanent structure had been constructed at the site.

In view of the aforesaid, we dispose of the writ petition by restraining the respondents from taking any coercive action against the writ petitioner, provided he is found at all times to be in compliance with the terms and conditions of the Vending Certificate which is held by him.

The respondents shall also ensure that the petitioner does not violate the terms of the license or any other rules, regulations and schemes that may be applicable and which regulate the site at which vending activity may be undertaken.
