The present writ petition has been filed seeking directions to the respondent no.1/MCD, to take action against the encroachment upon public land and cease any construction activity outside shop bearing No. 409, Katra Choban, Chandni Chowk, Delhi-110006.

Status report has been filed on behalf of the respondent no.1/MCD wherein it is stated that the subject property was inspected by the officials of MCD on 30th October, 2024.

would not amount to unauthorized construction. 3.

Insofar as encroachment of the public land in the form of Thara/extended platform, it is submitted that there is no layout plan of the area in question and therefore, it is not possible to ascertain whether the extended platform is an encroachment of public land or not. 4.

It is not a disputed position that the Thara/extended platform has been in existence since the time the respondent no.2 purchased the said property in 2016.

In light of the aforesaid submissions, the relief sought in the present petition cannot be granted.

Accordingly, the present writ petition, along with all pending application(s), stands disposed of.
