This is a writ petition seeking quashing of the FIR no. 0251/2025 dated 31.07.2025 registered with PS Vikaspuri, under Sections 79/351(2) BNS, 2023.

The Ld. Senior Counsel appearing for the petitioner submits that lodging of FIR is an abuse of process of law. shows that complainant herself at her own came to the house of the petitioner. He states that petitioner had lodged as many as six complaints against the complainant but no action has been taken and therefore, she was constrained to file complaint along with application under Section 156(3) Cr.P.C. before the Trial Court. He further submits that petitioner has already joined the investigation and duly co-operated in the investigation. 3.

The Ld.ASC appearing for the State submits that the FIR was registered on 31.07.2025 and the matter is under investigation. The investigation has just begun and the present petition has been filed prematurely without waiting for the outcome of the investigation and filing of the final report.

At this stage, the Ld. Senior Counsel seeks permission to withdraw the present petition along with pending application(s) with liberty to file fresh petition after culmination of the investigation. 5.

The statement made by the Ld. Senior Counsel is taken on record and petition along with pending application(s), if any, is dismissed as withdrawn with the liberty as prayed for.
