The Petitioners allege encroachments and unauthorised constructions carried out by Respondent Authorities on the common land on Khasra no. 42 (old Khasra no. 172) situated in the village Kharkhari Jatmal, Najafgarh, South West District, Delhi-110043.

To this effect, the Petitioners have also submitted a complaint dated 05th April, 2024 to the concerned Sub-Divisional Magistrate, Kapashera, requesting for his intervention to stop the illegal encroachment, but to no avail.

Considering the above, in the opinion of the Court, in terms of the directions issued by the Division Bench in Devender v. GNCTD1 and in 1 W.P. Accordingly, the present petition is disposed of with a liberty to the Petitioners to raise their grievances before the STF by filing an appropriate representation narrating their grievance. The STF shall consider the same in accordance with law.
