O R D E R

% 09.04.2018 Learned senior counsel for petitioner submits that prosecutrix is about 32 years of age and has two children whereas petitioner is aged about 30 years.

Petitioner and prosecutrix were in a relationship. Photographs have been placed on record supporting this version. It is further submitted that after their relationship broke off, prosecutrix has lodged this FIR.

Petitioner had never promised to marry the prosecutrix. Prosecutrix was already married. She has taken divorce from her husband much later.

Learned APP has vehemently opposed the bail application. It is contended that petitioner forced the prosecutrix to terminate pregnancy on six occasions.

Learned senior counsel for petitioner submits that medical papers are only in respect of two pregnancies. He further submits that

even otherwise, it is quite improbable that petitioner would have forced the prosecutrix to terminate pregnancy six times in a span of three years of their relationship.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
