Although the present petition seeks quashing of the FIR, Mr. Sanjeev Bhandari, ASC for the State, submits that a chargesheet has already been filed in the matter, wherein Petitioner No. 4 has not been arrayed as an accused.

Counsel for the Petitioners, in view of the above development, seeks to withdraw the present petition with liberty to raise all the grounds urged herein before the Trial Court at the appropriate stage. He further seeks liberty to challenge the order on charge, if passed against Petitioner No. 4, in accordance with law.

Dismissed as withdrawn with liberty as aforesaid. The Court has not commented on the merits of the case. All rights and contention of the parties are left open.
