The present petition has been filed by the petitioner in respect of an investigation initiated under the Customs Tariff (Identification, Assessment and Collection of Anti-Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 ("Anti-Dumping Rules, 1995") 4.

The initiation of the anti-dumping investigation was in respect of "Black Toner Powder Cartridge" ; the same was initiated vide notification The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Admittedly, in terms of the procedure prescribed in the aforesaid statutory rules, the initiation notification was followed by an investigation in which the concerned parties participated and were called upon to submit the relevant information; a hearing was also afforded in terms of the relevant rules. The investigation process led up to issuance of a disclosure statement dated 09.09.2025 but the investigation has not yet culminated in any "final findings" being issued by the designated authority. 6.

The grievance of the petitioner is that the disclosure statement dated 09.09.2025 enlarges the scope of 'Product under Consideration' (PUC). It transpires during the course of hearing that the petitioner's grievance with regard thereto has been articulated in the submissions submitted by the petitioner pursuant to the disclosure statement; the same has also been annexed as Annexure P1 to the present petition. 7.

During the course of hearing, it is stated by the learned counsel for the respondent/s, who appears on advance notice, that the said submissions of the petitioner shall necessarily be taken into account at the time of issuance of "final findings".

The same shall be subject to appellate remedies of the petitioner in the event of the any notification imposing anti-dumping duty being issued, based on the final findings.

In the circumstances, this Court is not inclined to interfere with the Investigation process at this stage.

Accordingly, the present petition stands dismissed, taking on record the aforesaid statement of the respondents that the objections/submissions submitted by the petitioner pursuant to the disclosure statement dated The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

09.09.2025 shall be taken into account by the designated authority at the time of issuance of "final findings".
