Appellant has assailed order dated 03.07.2025 of the learned trial court, whereby application of the respondent under Order XXXIX Rule 1&2 CPC was allowed thereby restraining the appellants from creating third party interest in the suit property. Learned counsel for appellant submits that she has already filed an application before the learned trial court for getting forensic examination of the alleged mortgage deeds. That being so, learned counsel, after addressing partly, seeks permission to withdraw this appeal with liberty to move appropriate application before the trial court depending upon the outcome of his pending application for forensic examination of the alleged mortgage deeds.

Accordingly, the appeal and the accompanying applications are dismissed as withdrawn with liberty as sought.
