BAIL APPLN. 3709/2024 The present bail application has been filed under Section 483 BNSS on behalf of petitioner seeking grant of regular bail in case FIR No. 70/2018 under Section 302/307/34 IPC registered at PS Paharganj. The petitioner has been in Judicial custody since 12.03.2018.

At the outset, learned counsel for the petitioner submits that there are two witnesses left to be examined and now the matter is fixed for 25.10.2024. Learned counsel submits that some directions may be issued to conclude the prosecution evidence expeditiously. Ld. Trial Court is requested to conclude the prosecution evidence on 25.10.2024 or if it spills over, to proceed on day-to-day basis. Learned counsel submits that, in view of this, the petitioner does not wish to further press this application and seeks permission to withdraw the present bail application.

In view of the submissions made, the present bail application stands dismissed as withdrawn. However, it is made clear that this court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression on the merits of the case.
