In furtherance of last order, learned counsel for petitioner on instructions seeks permission to withdraw this petition with liberty to raise all grounds as raised in the present petition before the trial court during final arguments. The order impugned in the present case was dismissal of the application under Order VII Rule 11 CPC and there having been no stay, the trial proceedings continued and have now reached the stage of final arguments. In terms with the legal position laid down in the case of Anokhe Lal vs. Radha Mohan Bansal & Ors., (1996) 6 SCC 730, it would be desirable that the issue be decided on the basis of evidence brought on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Under these circumstances, the present petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
