W.P.(CRL) 674/2018 Petitioners are seeking quashing of the present FIR i.e. FIR No.0858/2015 registered under Sections 498A/406 read with Section 34 of the IPC at police station Vasant Kunj North on the complaint of respondent no.2. Petitioner no.1 and respondent no.2 got married according to Hindu rites on 18.4.2014. They started living separately w.e.f. 15.11.2014. They have now been divorced by a decree of mutual consent dated 26.5.2017. In terms of their settlement petitioner no.1 has agreed to pay a sum of Rs.14 lakhs to respondent no.2 of which Rs.9 lakhs already stand paid and the balance sum of
Rs.5 lakhs is being paid today by way of a demand draft which has been accepted by respondent no.2. The presence of respondent no.2 has been affirmed by the Investigating Officer. Petitioners accordingly pray that the matter having been settled, the present FIR be quashed.
This is a fit case where the prayer made in the petitioner be granted. Accordingly, to secure ends of justice, FIR No.0858/2015 registered under Sections 498A/406 read with Section 34 of the IPC at police station Vasant Kunj North and all the proceedings emanating therefrom stand quashed.
Petition disposed of.
