By virtue of the present petition, the petitioner seeks transfer of Execution Case being EX (COMM) 43/2024 pending before the learned District Judge (Commercial Court), South-West District, Dwarka Courts, Delhi to the learned District Judge (Commercial Court), South-East District, Saket Courts, Delhi, to be heard and disposed of along with OMP (COMM) 62/2022.

Learned counsel for the petitioner submits that the very same parties as in EX (COMM) 43/2024 under Section 36 of the Arbitration and Conciliation Act, 1996 (the Act), are already embroiled in a dispute before the learned District Judge (Commercial Court), South-East District, Saket Courts, Delhi in the prior instituted OMP (COMM) 62/2022 under Section 34 of the Act qua the very same arbitral award dated 04.08.2022. Based thereon, he submits that it would be in the interest of justice, as also the parties, if the present petition is allowed and the two aforesaid proceedings The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. are heard by the same Court.

For the reasons stated in the present application, as also in view of the facts and circumstances involved, in the considered opinion of this Court the present application can be disposed of without issuance of any notice thereon.

As such, the present petition is allowed and EX (COMM) 43/2024 is transferred from the learned District Judge (Commercial Court), SouthWest District, Dwarka Courts, Delhi to the learned District Judge (Commercial Court), South-East District, Saket Courts, Delhi, to be listed along with OMP (COMM) 62/2022.

The concerned learned District Judge (Commercial Court), SouthWest District, Dwarka Courts, Delhi is directed to send the entire records pertaining to EX (COMM) 43/2024 to the concerned learned District Judge (Commercial Court), South-East District, Saket Courts, Delhi. 6.

A copy of the present order be sent to the learned Principal District and Sessions Judge, South-West District, Dwarka Courts, Delhi and the learned Principal District and Sessions Judge, South-East District, Saket Courts, Delhi for information and compliance. 7.

Accordingly, the present petition, along with the pending application, stands disposed of.
