% 14.08.2018 It is submitted that respondent has also filed a CS No. 489/2017, titled as Pawan Kumar pandit Vs. Brij Bala Rai before the SCJ/RD, North-East, KKD Courts, Delhi. Disputes between the parties was referred to Delhi Mediation Centre , Karkardooma Court, Delhi wherein the settlement has been arrived at between the respondent and Ms. Brij Bala Rai (wife of petitioner) on 07.08.2018. Petitioner has also signed the said settlement agreement before the Mediation Centre.

It is submitted that as per the settlement respondent has agreed for compounding of the offence under Section 138 of the Negotiable Instruments Act, 1881, subject to release of `90,000/- lying deposited in this Court to respondent.

Respondent is present in Court and submits that he has no objection if offence under Section 138 of the Act, is compounded subject to release of `90,000/- together with interest accrued thereon, if any.

Accordingly, offence under Section 138 of the Negotiable Instruments Act is permitted to be compounded. Petitioner is acquitted. `90,000/- lying deposited in this court along with interest accrued thereon, if any, be released by the Registry to respondent, immediately. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
