Second Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Applicant-Mohd. Ikram @ Arif for grant of Interim Bail for 15 days in SC No. 684/2019 CNR No. DLWT010096282019 arising out of FIR No. 0389/2019 under Section 302 IPC and Sections 25/27 Arms Act, registered at P.S. Punjabi Bagh. 2.
It is submitted that the Petitioner was arrested and is in judicial custody from 29.07.2019. He was released on Interim Bail for a period of 03 weeks on 18.07.2020, but could not surrender and his Bail was extended. He was again arrested on 26.07.2021 in FIR No. 0140/2021, P.S. Crime Branch, New Delhi in which, he has been admitted to Bail. 3.
He applied for Interim Bail before the Court of learned ASJ on 21.10.2024 but the same was dismissed. He filed Petition for Interim Bail for a period of 30 days vide Bail APPL. Medical Board to fully examine the Petitioner and if require, be admitted in the Hospital for effective medical treatment. 4.
The Petitioner again applied for Interim Bail on 02.06.2025 before the learned Trial Court but the same has been dismissed. 5.
The present Interim Bail Application has been filed on the ground that the Petitioner is a patient of L4 and L5 PIVD with T3 and T4 compressive myelopathy, hypertension and bronchial Asthama. He is not getting proper treatment at the Jail Hospital. It is only when the Petitioner filed an Application for Interim Bail before the learned Trial Court that he was taken to GB Pant Hospital for treatment on 26.05.2025. He is the sole financial sustainer of his family and has minor children who are entirely dependent upon him. He has deep roots in the society. Hence, Interim Bail is sought for a period of 15 days on medical ground.

The Medical Status Report has been submitted by the Jail Superintendent wherein it is submitted that on 26.05.2025, the Petitioner was sent to Jail Hospital for Neurosurgery follow up wherein he was advised to undergo PAC workup for spine surgery and further referred for PAC reference. He was thoroughly examined in PAC checkup and was advised for review by re-PAC after getting few additional blood investigations done through Jail Dispensary. His latest follow up for PAC fitness was done on 18.10. 2025 wherein some more fresh blood investigations have been directed to be conducted. The patient be again sent for re-PAC in the coming week.

It is further submitted that the Petitioner is in regular supervision of Jail Duty Doctor primarily, for his spine issued and reportedly he is not showing any further deterioration of his condition. Physiotherapy and medication from Jail Dispensary. The general condition of inmate is stable and he is receiving all applicable medical support from Jail Dispensary.

Learned APP has submitted the Status Report, which be taken on record. It is indicated that he is involved in 33 criminal cases. It is further submitted that the Petitioner is being provided with regular treatment and his condition is stable. It is also submitted that on one occasion when he was admitted to Interim Bail, he committed another offence. Therefore, there exists no circumstances for grant of Interim Bail. Submissions heard and record perused.

Essentially, the grievance of the Petitioner is that he is not given regular follow up treatment and it is only when he approaches the Court that he is taken for his follow up treatments.

Considering the submissions and also the medical report, which shows that the condition of the Petitioner is stable, no ground for Interim Bail is made out. However, the Petitioner be taken for the treatment as and when the situation so arises. It is also clarified that if the surgery is required, the same be also got done by the Jail Authorities. 11.
The Bail Application alongwith pending Application is disposed of accordingly.
