Petitioner herein seeks initiation of contempt against his estranged wife for willfully disobeying the specific directions given by this Court on 24.11.2023 in Cont.Cas(C) 1698/2023. 2.
It needs to be highlighted right here that the petitioner had earlier filed a contempt petition against respondent for violation of one order dated 10.10.2023 passed by learned Judge, Family Court in HMA 50827/2016. However, while considering the above said contempt petition on the basis of the assurance given by the respondent (mother) that there would be a video conferencing meeting between the child and his grandmother, at least, for ten minutes every day, the above said contempt petition was disposed of.

It is now averred in the present contempt petition that despite there being said specific assurance and direction by this Court, the CONT.CAS(C) 1624/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned counsel for respondent, who appears through video conferencing, submits, on instructions, that the child is now no longer interested in having any such interaction through video conferencing as his father keeps threatening him that he would be sent behind the bars. 5.
Such assertion has been refuted by learned counsel for the petitioner.

Be that as it may, after hearing arguments for some time from both the sides, the respondent assures that she would rather move appropriate application before the concerned Family Court in the above said HMA 50827/2016 placing her version before the Court and seeking requisite modification of the above said order. The next date in such HMA is stated to be 24.02.2025.

It is also assured by learned counsel for the respondent, on instructions, that, in the interregnum, till the above said application is moved and any further direction is made therein, the respondent shall ensure that the above said assurance given by her, as reflected in order dated 24.11.2023, is duly complied with.

Such statement is taken on record.

In view of the above said assurance given by learned counsel for the respondent, the petitioner, at the moment, does not press his contempt petition.

The petition stands disposed of accordingly. Liberty, as prayed, is granted.
