The present case has remained on the Regular Board since 21st January, 2016. When the matter was taken up on 1st February, 2016, none was present on behalf of the petitioner.

Again on 9th February, 2016, learned counsel for the petitioner stated that he would be taking steps to file his power of attorney and would collect the case file from the previous counsel and at his request, the matter was directed to be listed in the category of 'Regulars', in the week commencing from 15th February, 2016.

On 16th February, 2016, again Mr. Kamlesh Kumar Mishra, learned counsel for the petitioner, had stated that he had not received any W.P.(C). 24002/2005

instructions from the petitioner. In the interest of justice, last opportunity was granted to him to file the power of attorney and come prepared with the brief.

Today, proxy counsel appearing for Mr. Kamlesh Kumar Mishra, Advocate, states that despite best efforts made by the said counsel, he has not been able to contact the petitioner or obtain a power of attorney, nor has he received any instructions from her.

In view of the said submission, the present petition is dismissed for non-prosecution.
