Applicant seeks pre-arrest bail in case FIR No. 139/2024, registered at Police Station Kirti Nagar under Sections 420/468/471/120-B IPC. 2.

FIR was registered on basis of allegations that applicant, her husband and their son had taken loan from M/s Hinduja Housing Finance Ltd. and while taking loan, they had offered one property of Mansarover Garden as collateral.

Later on, it was found that the said property had already been mortgaged to Karvy Financial Services Ltd. from where loan of Rs. 2.50 crores had been availed by husband of applicant. 4.

Garden was mortgaged by husband of applicant while claiming himself to be the owner of the property. When the present application was taken up by the learned Predecessor Bench on 18.09.2025, State was directed not to arrest her on her joining and co-operating with the investigation. The above order continues to be in operation. It is apprised that charge-sheet qua some of the accused has already been filed.

When asked about the husband of the applicant, it was apprised by learned Addl. P.P. for the State that he has already been declared proclaimed offender.

Applicant is, reportedly, 54 years of age, with no previous involvement.

Keeping in mind the overall facts and circumstances of the case, the aforesaid order dated 18.09.2025 is made absolute and the application is disposed of with the direction that the applicant, as and when so directed by the investigating agency, shall join the investigation and in case of her arrest, the arresting officer shall release her on bail on her furnishing personal bond and surety bond in a sum of Rs. 25,000/- each. 8.

Pending application stand disposed of in aforesaid terms.
