% 12.03.2018 By this petition, the petitioner seeks interim bail on the ground that he has to deposit the school fee of the two daughters. On a notice being issued a status report has been handed over which is taken on record. As per the status report the petitioner is involved in the murder of his own mother-in-law by firing gun shot. Statements of wife of the petitioner, who has now filed the present petition as a parokar, besides her family members were recorded during investigation. Even statement of the minor daughter of the petitioner was recorded under Section 164 Cr.P.C. As per the status report the two daughters of the petitioner are studying in Mata Jai Kaur School in Ashok Vihar and Tyagi Public School in Keshav Puram in class 6th and L.K.G. respectively, however the school fee of the two children has not been paid since November, 2017 till BAIL APPLN. 554/2018
date. As reflected in the status report the standard of living of the petitioner's wife shows that she is competent to pay the school fee of the two children and besides the brothers and mother of the petitioner are also there to look after the two daughters of the petitioner. Considering the standard of living of the wife of the petitioner and the possibility that from November, 2017 till date payments of fee was not made could be with a view to create a ground for grant of interim bail cannot be ruled out, petition is dismissed.
