Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner for quashing of FIR No. 960/2023 under Sections 288/337 IPC registered at P.S.: New Usmanpur and proceedings emanating therefrom. 2.

Issue notice. Learned APP for the State and learned counsel for respondent No.2 alongwith respondent no. 2 in person appear on advance notice and accept notice.

investigation and the final report is yet to be filed. He further submits that it is yet to be inferred in case any other person apart from petitioners is to be arrayed as an accused.

At this stage, learned counsel for the petitioner seeks to withdraw the petition without prejudice to the rights and contentions of the petitioner with liberty to file the same afresh after filing of final report by investigating agency.

Taking the statement of learned counsel for the petitioner on record, petition is accordingly disposed of.

IO concerned is further directed to conclude the investigation within a period of three months from the date of passing of this order. Pending applications, if any, also stand disposed of.
