This suit was instituted by the Plaintiff seeking a decree of permanent injunction against Defendant No. 1 restraining from manufacturing, marketing, trading, selling and/or using in any manner in relation to any product inter alia welding electrodes, welding consumable and related products, bearing the impugned mark SUPERWELD/ and/or any other mark/device/logo/sign/domain name or trade name which is identical and/or deceptively similar to Plaintiff's prior and registered trademarks , , , , without permission, consent or license of the Plaintiff, amongst other reliefs. During the pendency of the suit, parties were referred for mediation before the Delhi High Court Mediation and Conciliation Centre, where they have amicably resolved their inter se disputes and a Settlement Agreement dated 22.12.2025 has been executed between the parties, incorporating the terms of settlement, which includes the recognition of the proprietary rights of the Plaintiff in the subject trademarks.

Court has perused the terms of settlement and finds the settlement to be lawful. Accordingly, the suit is decreed in terms of the Settlement Agreement dated 22.12.2025 read with paragraph 58 (a), (b), (c), (d) of the plaint as also (f) to the extent of the settlement between the parties. 4.
Registry is directed to draw up the decree sheet. 5.
Suit is disposed of.

Plaintiff is held entitled to refund of entire court fees in accordance with Court Fees Act, 1870.

The Certificate of Refund shall be issued in the name of 'KING STUBB & KASIVA', at Unit-14, Ground Floor, DLF Tower-A, Jasola, New Delhi-110025.
