By virtue of the present petition, the petitioner seeks transfer of the suit instituted by him bearing no. CS 7984/2016 titled as 'Rajan Kapur v. OCM Private Limited' pending before learned Additional District Judge, South-East District, Saket Courts, Delhi (learned ADJ) to this Court, to be listed along with the suit bearing no. CS (OS) 1524/2011 titled as 'Rajeev Sharma v. OCM Private Limited' pending before this Court. 4.

same subject matter, i.e. sudden termination of the services of five individuals who constituted the management of the respondent, two of whom are the respective plaintiffs in the aforesaid suits. He submits that while the petitioner had also instituted his suit originally before this Court, however, on account of Notification No.27187/DHC/Orgl. dated 24.11.2015 issued by Hon'ble the then Chief Justice of this Court, the same was transferred to the learned ADJ vide order dated 29.01.2016 passed by this Court.

Learned counsel submits that now CS 7984/2016 is listed for final arguments before the learned ADJ on 24.09.2025, as also CS (OS) 1524/2011 is listed for final arguments before this Court on 25.09.2025. In view thereof, he submits that it would be in the interest of justice, and to avoid any conflicting judgements, that both the suits are heard and decided by the same Court.

Issue notice.

Learned counsel appearing for the respondent through video conferencing accepts notice. He submits that he has no objection if the present petition is allowed and CS 7984/2016 is transferred to this Court to be listed along with CS (OS) 1524/2011.

In view of the submissions made by learned counsels for the parties, as also in view of the facts and circumstances involved, CS 7984/2016 pending before the learned ADJ is transferred to this Court to be listed along with CS (OS) 1524/2011.

The concerned ADJ, South-East District, Saket Courts, Delhi is directed to send the entire records pertaining to CS 7984/2016 to this Court.
