% 28.11.2025 CM APPL. 74823/2025 By way of the present joint application filed under section 151 of the Code of Civil Procedure 1908 ('CPC'), the appellant and contesting respondents seek modification of the judgment and decree dated 30.05.2024 passed by the learned trial court in suit bearing CS SCJ No. 95931/2016. The first appeal against the said judgment and decree was dismissed vide judgment dated 25.07.2025 passed in appeal bearing 26 RCA DJ No. 97/2024.

Learned counsel appearing for the parties submit, that the contesting parties have settled the matter amicably in the terms contained in Compromise Deed dated 21.11.2025, a copy of which has been appended to the application.

Learned counsel submit, that under the compromise deed, the tenancy dispute in respect of Shop No.1628, Old Katra Marwari, Nai Sarak, Delhi has been settled; and the said shop has been delivered back to the appellant.

For clarity, upon being queried, learned counsel for the appellant confirms that the appellant had made no claim against respondent No. 6 (his brother) and respondent No.7 (the joint tenant) who (latter), had already surrendered the tenancy in favour of the appellant back in 1996.

Learned counsel for respondents Nos. 1 to 5 are present. Respondents Nos. 2 and 4 are also present in-person; and respondent No.2 is also the Special Power of Attorney holder for the legal representatives of respondents Nos. 1, 2, 3 and 5.

The terms of the compromise appear fair and lawful. 7.
Accordingly, the terms of the compromise are taken on record. Parties are held to be bound by the terms of the compromise. 8.
Impugned judgment and decree dated 30.05.2024 passed by the learned trial court in suit bearing CS SCJ No. 95931/2016 is modified in the terms contained in Compromise Deed dated 21.11.2025. 9.
The appeal is disposed-of in the above terms. 10.
Pending applications, if any, stand disposed-of. 11.
A fresh decree-sheet be drawn-up in terms of the compromise. 12.
The date of 09.12.2025, given earlier, before the learned JointRegistrar stands cancelled.
