The present petition has been filed under Section 528 of BNSS seeking quashing of FIR No. 0404/2021 under Sections 498A/406/34 IPC registered at P.S. Jaitpur and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement. 2.

Issue notice. Ms. Richa Dhawan, learned APP for State accepts notice. She points out that in the FIR two more persons were arraigned as accused and they have not been impleaded as respondents in the present petition.

On the oral request of learned counsel appearing on behalf of the petitioner, other two accused persons are also impleaded as respondent nos. 3 and 4. The amended memo of parties has been handed over across the bar, the same is taken on record.

Petitioners, respondent no.2 and the newly added respondent no.3 namely Radhey Shaym Mahto are present in Court. They have been identified by Mr. Raghav Saluja, learned counsel for petitioners, Ms. Tanisha Verma, Advocate for respondent no.2 as well as, by Investigating Officer IO/SI Inderjeet, PS-Jaitpur.

The brief facts of the case are that the marriage between petitioner no.1 and respondent no. 2 was solemnized on 09.11.2019 according to Hindu Rites and Customs. However, on account of some temperamental issues, certain disputes arose between the parties and they started living separately since 21.08.2021. The dispute between the parties also led to the registration of present FIR.

During pendency of the proceedings, the parties have arrived at a settlement, terms whereof were reduced in writing in the form of Memorandum of Settlement/Settlement Deed dated 27.09.2023, copy of which is annexed as Annexure-B to the present petition. 7.

In terms of the said settlement, the parties decided to dissolve their marriage by filing a petition for divorce by way of mutual consent. Accordingly, petitioner no.1 and respondent no.2 have obtained decree of divorce dated 22.01.2024 (Annexure C).

It is a term of the settlement between the parties that the petitioners shall pay a total sum of Rs.2,00,000/- to the respondent no.2 towards full and final settlement of all her claims on account of streedhan, permanent alimony, dowry articles, maintenance (past, present and future) etc., out of which an amount of Rs.1,50,000/- has already been paid by the petitioners to respondent no.2 in the manner stated in the settlement. Balance amount of Rs.50,000/- has been paid today in the Court by way of Demand Draft The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The receipt of entire amount of Rs.2,00,000/- is acknowledged by respondent no.2, who is present in court.

On a query posed by the Court, the respondent no.2 states that she does not wish to prosecute criminal proceedings any further and has no objection in case the FIR is quashed.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 13.

Consequently, the petition is allowed and the FIR No. 0404/2021 under Sections 498A/406/34 IPC registered at P.S. Jaitpur alongwith all other proceedings emanating therefrom, is quashed. 14.

The petition stands disposed of in the above terms. 15.
