This is an application for grant of interim bail for a period of 21 days, filed on behalf of the petitioner in Case FIR No. 244/2024, under Section 302/201 IPC and Section 27 Arms Act, PS Kalindi Kunj. 2.
The present bail application has been preferred on the ground of surgery of petitioner's father, who is stated to be suffering from Ambilical Hernia. It is submitted that surgery is to be performed on 23.09.2025. 3.
The application has been opposed by the learned APP, stating that even if granted bail, the petitioner may not be able to attend the surgery tomorrow. He further submits that the married sister of the petitioner can also attend to her father at the time of surgery. According to him, petitioner is facing trial for the commission of offence under Section 302 IPC. The allegations against him are grave and serous in nature and therefore there is possibility that upon being granted interim bail, he may jump the bail. Status Report filed, which is taken on record. The status report confirms that the father of the petitioner is suffering from Ambilical Hernia and his surgery is to be performed on 23.09.2025. As per report, besides the petitioner, his wife and two minor children are there in the family. 5.
Since the medical condition of the father of the petitioner has been verified and his surgery is to be performed on 23.09.2025, I deem it appropriate to grant interim bail to the petitioner for a period of 15 days from the date of his release, upon his furnishing a personal bond in the sum of Rs. 50,000/- with one surety of the like amount to the satisfaction of the trial court/learned MM/Duty MM, subject to the following conditions:- i) that the petitioner shall not try to contact any of the prosecution witnesses during the period of interim bail nor shall try to threaten or intimidate them;
ii) that upon being released, petitioner shall share his mobile phone number as also his permanent and present address with the I.O. and shall keep his mobile number operational throughout; iii) that petitioner shall cooperate during the trial and shall appear before the trial court as and when directed during this period; iv) that petitioner shall not leave the NCR without the permission of the trial court and shall surrender immediately upon completion of the interim bail period and not shall not seek extension on account of any reason whatsoever.

The bail application is accordingly allowed.
