W.P.(CRL) 3182/2024 The present petition has been filed under Article 226 of the Constitution of India r/w Section 528 BNSS with the following prayer: "(a) Issue appropriate writ, order or direction to the Respondent No.1 and Respondent no. 2 to restore the protection granted to the petitioner of one PSG (round the clock) - Total 3 PSOs, and One Armed Guard round the clock (Day and Night) - Total 2 Arm Guards at his residence.

Learned counsel for the petitioner submits that, in pursuance of the order dated 20.02.2023 in writ petition W.P.(CRL.) 585/2021, the matter was considered by the Witness Protection Committee. The Witness Protection Committee, in its meeting dated 25.05.2023, took into account the threat perception and provided security to the petitioner, with a directive for review after three months. Learned counsel further submits that, to his knowledge, no subsequent meeting of the Witness Protection Committee has been held, nor has he been informed of any order withdrawing security. Additionally, learned counsel states that around 7-8 days ago, without any written order, the security provided to the petitioner was withdrawn. Learned Counsel further submits that he would be satisfied if the matter is referred to the Witness Protection Committee and, until the matter is considered, the security cover provided to the petitioner in terms of the minutes of the meeting dated 25.05.2023 be continued. Issue notice.
Learned ASC for the State has accepted the notice and submits that, as per instructions, the DCP of the area, who is a competent authority, has ordered the withdrawal of the security cover provided to the petitioner. The Court considers that, in accordance with the order dated 20.02.2023 in W.P.(CRL.) 585/2021, the present petition shall be treated as a representation to the competent authority designated under the Witness Protection Scheme and the competent authority, after reviewing the necessary inputs regarding the threat perception assessed by Delhi Police, will make a decision within four weeks and inform the petitioner.
