Petitioner has assailed order dated 11.02.2025 of the learned trial court, whereby the respondent/DDA (defendant no.1 in suit) was granted opportunity to lead additional evidence to prove that the lease deeds relied upon by the petitioner/plaintiff were forged and fabricated. 2.
Learned counsel for respondent/DDA appears on advance intimation and accepts notice. Learned counsel for respondent/DDA on instructions also undertakes that no other witness shall be sought to be examined and no adjournment shall be taken by respondent/DDA before the trial court so that the suit get decided expeditiously.

After addressing partly, learned senior counsel for petitioner on instructions seeks permission to withdraw this petition going by the assurance of learned counsel for respondent/DDA that no further witness would be sought to be examined.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn. Of course, the petitioner shall have liberty to lead rebuttal evidence in response to the additional evidence led by the present respondent/DDA in terms with the impugned order.
