% 09.03.2018 CM No. 9012/2018 This is an application filed by the petitioner seeking disposal of the present petition in the light of the earlier orders passed by this Court in similar facts and circumstances.
Issue notice. Ms.Monika Arora, learned counsel for the respondents accepts notice and does not oppose the application. In view of the similar directions passed by this Court in WP (C) No.7337/2017, WP(C) No.135/2018 & others, the present application is allowed. The next date of hearing i.e. 04.04.2018, stands cancelled. W.P.(C) 2018/2018 Vide the present petition, the petitioner/Institute has prayed for a direction to the respondents to reconsider its application dated 31.12.2012 for the grant of recognition to conduct B.Ed. course, which was returned unactioned by respondent No.2 vide letter dated
24.04.2013.
Learned counsel for the petitioner points out that the said application was returned only on the ground of the ban imposed by the State of Haryana for opening of new institutes for the B.Ed. course during that period.
Ms.Monika Arora, Advocate who appears on advance notice for the respondents fairly submits that the respondents have taken a decision to process all the applications which were submitted by the Institutes before the imposition of the ban by the State Government. Learned counsel for the respondents, however, submits that keeping in view the fact that the petitioner's application was returned over 4 years ago, the respondents may be given adequate time to examine and process the same as per law.
Subject to petitioner's depositing Rs.10,000/- with Delhi High Court Staff Welfare Fund, the writ petition is allowed. The respondents are directed to reconsider the petitioner's application dated 31.12.2012 subject to the petitioner meeting all other prescribed eligibility criteria and dispose of the same by passing a reasoned and speaking order within four weeks from today. It is made clear that the petitioner's application would not be rejected on the ground of there being a ban imposed by the State of Haryana for opening of such educational Institutions.
The petition stands disposed of with the above directions. DASTI.
