Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking protection from Respondent Nos.2 to 4, who are Petitioner's son and daughters, against whom the allegations are made that they are residing with her in the house and she wants them to be evicted and be protected from being beaten by them regularly. 2.
Petitioner's complaint is that after demise of her husband, Respondent Nos.2 to 4, who are her own children, have been ill-treating her and giving her beatings and making her life difficult in her own house. It is also submitted that Respondent Nos.2 to 4 are residing of 2nd and 3rd floor, while the Petitioner resides on the ground floor of same property. 3.
Learned counsel for the Petitioner submits that Petitioner has already approached the Senior Citizens' Tribunal seeking appropriate relief. 4.
