Briefly stated, as per the case of prosecution, complainant-Naveen Jeena, who wanted to purchase some property in Uttam Nagar, Delhi, was required to arrange some money and came in contact of some known persons i.e. Harsh Nainwal and Vinod Singh (co-accused herein). When he approached them, as directed by them, he transferred some money through online banking and in return, the abovesaid accused gave him a bag which was containing the cash. However, when the complainant, later on, checked up the bag, it was found containing dummy notes. When the complainant went back to the same address again, he found that those accused persons had absconded and it was in the abovesaid background that the matter was reported to the police.

During course of the investigation, the police checked up the concerned bank account and learnt that the abovesaid amount of Rs.40 lacs, which had been transferred through online banking, was further transferred to three different accounts. One such account was of M/s Jimmy Multitrade Private Limited in Kotak Mahindra Bank, Mumbai wherein a sum of Rs.3.5 lacs had been transferred.

Both the applicants were served with notice and they both joined investigation but according to them, said amount was in relation to one deal with one customer Ashutosh.

The charge-sheet against the main accused persons has already been filed. They are, reportedly, on regular bail. 6.
When the present applications were taken up on 18.09.2025 by the learned Predecessor Bench, there was direction to the investigating agency to not take any coercive steps against the applicants. were also directed to join the investigation. They also undertook to deposit sum of Rs.3.5 lacs, though, according to them, the abovesaid amount had nothing to do with the offence in question and it was in connection with some dealing which they had with other customer. 7.
The abovesaid amount has already been deposited with the Registry and it is informed that the investigation with respect to the applicants is also over.

Keeping in mind the overall facts and circumstances of the case, the role attributed to them and the fact that the amount which landed in the bank account of the applicants has duly been secured, albeit, without making any observations on the merits of the case, the abovesaid order dated 18.09.2025 is, hereby, made absolute and it is directed that applicants shall keep on assisting the investigation and in the event of their arrest, they be released on bail by the concerned SHO/IO/arresting officer, on their furnishing personal bond and surety bond in a sum of Rs.25,000/- each. 9.
