By way of present petition, the petitioner seeks quashing of FIR bearing no. 212/2023, dated 05.05.2023, registered at Police Station Punjabi Bagh, New Delhi for the commission of offences punishable under Section 174-A of the Indian Penal Code, 1860 (hereafter 'IPC'). 7.

Briefly stated, facts of the present case are that, in the year 2020, respondent no.2 had instituted the criminal proceeding under Section 138 of the Negotiable Instruments Act, 1881 (hereafter 'NI Act') on the basis of cheque issued by the petitioner to respondent no. 2. It is stated that on 10.03.2023, the learned JMFC NI Act had declared the petitioner as a Proclaimed Offender and had directed the SHO concerned to register the proceeding under Section 174-A of the IPC. Thereafter, the present FIR was registered against the petitioner under the relevant sections. 9.
It is stated that both the parties have now amicably settled the present matter and a certified copy of the No Due Certificate, issued by respondent no.2, has also been placed on record.

On a query made by this Court, the authorized representative of respondent no.2, who has been identified by the counsel, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by the authorized representative of respondent no. 2 that the entire dispute has been amicably settled between the parties. The authorized representative of respondent no. 2 further states that he has no objection if the present FIR is quashed. 11.
In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 12.
