By way of the present application, the applicant is seeking grant of regular bail in case arising out of FIR bearing no. 299/2025, registered at Police Station Sunlight Colony, Delhi for the commission of offences punishable under Sections 109(1)/3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereafter 'BNS').

Briefly stated, the facts of the present case are that the present FIR was registered on the complaint filed by the complainants, alleging therein that a vicious and coordinated attack on them by a large mob on 21.07.2025 at 01:00 AM. The mob's actions resulted in stabbings to both the complainants Md. Asgar Khan was stabbed near a nala and Ankush was stabbed in front of his residence near Nafisa Masjid. 3.
The learned counsel appearing on behalf of the applicant argues that the applicant has been falsely implicated in the present case, as his name has not been mentioned in the present FIR. The learned APP for the State, on the other hand, argues that the allegations against the present applicant are serious in nature and the investigation in this case is still pending. It is thus prayed that the present application for bail be rejected.

This Court has heard arguments addressed on behalf of both the sides and has perused the material available on record. 6.
After hearing arguments and going through the case file, this Court is of the opinion that admittedly, the applicant was not visible in the CCTV footage, collected on the incident in question. The applicant is in judicial custody since 22.07.2025 and the conclusion of the trial will take sometime. 7.
Considering the overall facts and circumstances of the case, this Court is inclined to grant regular bail to the applicant herein, on his furnishing personal bond in the sum of Rs.10,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/Successor Court/Link Court/Duty Judge concerned on the following terms and conditions: i) The applicant shall not leave the country without prior permission of the concerned Court and if the applicant has a passport, he shall surrender the same to the concerned trial court. ii) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned Court and IO/SHO concerned.
iii) The applicant shall appear regularly before the learned Trial Court, unless exempted.

Accordingly, the present bail application stands allowed and is disposed of.
