An Application under Section 483BNSS has been filed on behalf of the Applicant/Petitioner Sudeep Kumar for grant of Bail in FIR No.62/2018 under Section 302/120B/147/149 IPC registered at Police Station Rajouri Garden.

It has been he has been falsely implicated in this case and has nothing to do with the alleged offence. He is in Judicial Custody since 11.04.2024. His first Bail Application was rejected by learned ASJ on 28.10.2024. The second Bail Application got rejected on 08.07.2025. 3.

As per the case of the Prosecution, the deceased Niranjan was seen beaten with sticks and knives on 19.01.2018 by Praveen who had a big knife, Kamal @ Nitin and along with 4-5 other persons. These assailants fled from the spot when Sumit brother of the deceased brother of the Complainant and his mother shouted for help. Deceased was taken to Guru Gobind Hospital by his brother and mother, where he died on the following day. The Chargesheet has been filed on 16.04.2018. The Charges were framed under Section 302 read with Section 120B IPC/147/149 IPC vide Order dated 18.10.2018. There were 11 accused in all except the Applicant have already been released on Bail. All material witnesses stand examined. Out of 38 prosecution witnesses, 19 witnesses have been recorded till date. Public witnesses stand recorded. It is submitted that no fruitful purpose would be served in retaining the Applicant in Judicial Custody. Hence, a prayer is made for grant of Bail.

The Status Report has been filed today, which be taken on record, wherein it details of investigation and filing of Chargesheet has been detailed. The Bail is opposed on the ground of he being actually involved in the present case and being earlier involved in one other case of Section 392 IPC. The knife which was weapon of offence and was used for stabbing the deceased, had been recovered at his instance. The CCTV footage clearly shows that accused persons were holding the weapon. 20 witnesses in all have been recorded and other key witnesses are yet to be examined. The Bail is, therefore opposed.

As per the submissions made the accused was arrested in 2018, but was released on Interim Bail on account of Covid-19 and had thereafter been arrested on 11.04.2024. All material public witnesses already stands recorded. All other co-accused have been already granted Bail. the case of the Prosecution. His role is similar to Rohit who has been granted Bail on 07.08.2025.

Considering the totality of circumstances, the accused is granted Regular Bail, on the following terms and conditions: a) The petitioner/accused shall furnish a personal bond of Rs.25,000/- and one surety of the like amount, subject to the satisfaction of the learned Trial Court.

b) The petitioner/accused shall appear before the Court as and when the matter is taken up for hearing;

c) The petitioner/accused shall provide his mobile number/changed mobile number to the IO concerned which shall be kept in working condition at all times;

d) The petitioner/accused shall not indulge in any criminal activity and shall not communicate or intimidate the witnesses. e) In case the petitioner/accused changes their residential address, the same shall be intimated to learned Trial Court and to the concerned I.O.

The copy of this Order be communicated to the concerned Jail Superintendent as well as to the learned Trial Court. 8.
