The present petition has been filed seeking following relief: "a) Issue a writ of mandamus or any other appropriate writ, order or direction thereby directing the Respondent No. 2 to forthwith issue and hand over the Transfer Certificates of the Petitioners, namely (i) Master Pratham Jangid and (ii) Master Jainesh Jangid, without insisting on payment of alleged outstanding fees as a precondition;
b) Issue appropriate directions to Respondent No. 1 to initiate strict action against Respondent No. 2 for violation of the Delhi School Education Act, 1973, and the Rules framed thereunder, including but not limited to Rule 167 of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
the DSEAR, 1973, for illegally withholding the Transfer Certificates of the Petitioners and jeopardizing their fundamental right to education;
c) Direct Respondent No. 2 to pay to the Petitioners the costs and litigation expenses incurred in filing, pursuing, and prosecuting the present writ petition as compensation for the harassment, inconvenience, and avoidable litigation compelled by the arbitrary and illegal action of Respondent No. 2 in withholding the Transfer Certificates." 4.
Mr. Aditya Kapoor, learned counsel appearing on behalf of petitioner submits that the petitioners were studying in respondent no.2 school. However, on account of financial crisis in the family, the father of the petitioners had to shift his business operation from Delhi to Jaipur and accordingly, he got the petitioners admitted to a school in Jaipur. 5.
Mr. Kapoor submits that because of aforesaid reason, a request was made to the respondent no.2/school for issuance of Transfer Certificates, however, the same have not been issued for the reason that the petitioners have not paid the fee for the period April to September, 2025. 6.
He submits that under Rule 167 of the Delhi School Education Rules, 1973 the name of the students can be struck off from the rolls of the school on account of non-payment of fee, but it does not empower a school to withhold Transfer Certificate.

In that view of the matter, issue notice. Mr. Atul Jain, learned counsel appearing on behalf of respondent no.2/school accepts notice. 8.
On instructions, he submits that the Transfer Certificates will be issued to the petitioners within a period of three days. The statement is taken on record and the respondent no.2 school shall remain bound by the same. 9.
