O R D E R

The present writ petition has been filed seeking directions to the respondent authorities to take action against the unauthorized and illegal construction being carried out in the property bearing No. 2042, Pillanji, Kotla Mubarakpur, New Delhi-110003, by respondent no. 5. 2.

At the outset, learned counsel for the respondent-Municipal Corporation of Delhi ("MCD") submits that a civil suit being CS SCJ 697/2025, titled as "Rohit Baisoya Versus Narayan Singh & Ors.", has already been filed with respect to the same property. 3.

Judge, South East District, New Delhi in Saket Courts and the next date in the said case is 17th November, 2025.

Learned counsel for the MCD further submits that the property already stands booked, and on account of ongoing construction, a Work Stop Notice dated 15th September, 2025 has already been issued. 5.

Learned counsel for respondent no. 5 submits that the civil suit has been filed by the nephew of the petitioner herein. Thus, it is submitted that the same family is filing the present petition. 6.

Having heard learned counsels for the parties, this Court notes that since a civil suit has already been filed with regard to the same cause of action, with respect to the same property, and action has already been initiated by the MCD, no directions are required to be passed in the present petition.

However, it is directed that, in case of any ongoing unauthorized construction in the property in question, the concerned officials of the MCD, with the assistance of the Station House Officer ("SHO"), Police Station Kotla Mubarakpur, shall ensure that no further unauthorized construction takes place in the property in question.

Needless to state that this Court has not expressed any opinion on the merits of the case.

Rights and contentions of all the parties are left open. 10.

Noting the aforesaid, the present writ petition, along with pending applications, is accordingly disposed of.
