Heard the learned counsel for the parties.

After arguing at some length, learned counsel for the appellant, on instructions from the appellant, in presence of appellant namely Mr. Om Ratan Goel, states that the appeal may be dismissed as withdrawn, however two weeks' time may be extended for making deposit of the amount under the order passed by the learned Single Judge.

Accordingly, the appeal is dismissed as withdrawn. However, we provide that the appellant will be permitted to make the deposit in view of the order passed by the learned Single Judge within two weeks from today. Let the authorities of MCD be apprised of this order by the learned counsel representing the MCD. In case of non deposit of the amount within the time being extended by this Court in this order, the consequences permissible under law shall follow.
