This appeal is under Section 43 of the CPC read with Section 13 of the Commercial Courts Act.

The parties, through the Delhi High Court Mediation and Conciliation Centre, SAMADHAN, has entered into a Settlement Agreement dated 06th May, 2026, a copy of which is placed on record. 4.

is duly executed by the parties.

A joint request is made that the appeal be disposed of in terms of the Settlement Agreement dated 06th May, 2026.

That being so, we deem it appropriate to dispose of the appeal in terms of the Settlement Agreement dated 06th May, 2026. 7.
The admissible court fee, in accordance with law, be refunded. 8.
As regards the amount deposited by the appellant before the Commercial Court is concerned, the counsel for the respondent, Mr. Tripathy, submits that the appellant can be permitted to withdraw this amount which is with the learned Commercial Court. 9.
In that view of the matter, we grant leave to the appellant to approach before the Commercial court for withdrawal of the said amount, and the Commercial Court shall deal with the request of the petitioner in terms of the Settlement Agreement.
