After some arguments, ld. Counsel appearing on behalf of the petitioner seeks permission to withdraw the instant petition. 2.

Accordingly, the petition along with pending application is dismissed as withdrawn.

I hereby make it clear that observations made by the ld. Additional Sessions Judge while granting bail vide order dated 02.02.2016 that respondent no.2 has clean antecedents as well as opinion regarding dispute between the parties to be of civil in nature, will not affect the trial for the reason that there are cases pending against respondent no. 2. 5.
