% 05.03.2018 The petitioner is seeking quashing of the present FIR i.e. FIR No.178/2017 registered at Police Station Netaji Subhash Palace under Section 354-A of the IPC on the complaint of respondent No. 2. Respondent No. 2 is present in person. Her presence has been identified by her counsel as also by the Investigating Officer. The averments and contents of the FIR have been perused. It is stated that this FIR has been got registered on a mis-understanding; the cost of the camera has now been paid by the petitioner to respondent No. 2. Parties having settled their disputes, a settlement deed dated 30.06.2017 is placed on record. Neither of the parties wishes to continue with the proceedings.

Learned counsel for the State at this stage points out that the

investigation has progressed and the petitioner was in the process of being declaring as proclaimed offender. Proceedings under Section 82 of the Cr.PC have been initiated against the petitioner. If the prayer made in the present petition is granted, it should be subject to cost. This is a fit case where the prayer made in the present petition be granted. Accordingly, to secure the ends of justice, FIR No.178/2017 registered at Police Station Netaji Subhash Palace under Section 354-A of the IPC and all proceedings emanating thereto are quashed subject to petitioner's deposited the cost of Rs.10,000/- with Delhi High Court Legal Services Committee within a period of two weeks.

Petition disposed of in the above terms.
