The present application has been filed seeking interim bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, read with Section 439 of the Code of Criminal Procedureon behalf of the petitioner, Amar Soni, in relation to Case F.I.R. No. 271/20219, registered under Sections 307/302/34 of the Indian Penal Code and Sections 25/27/54/59 of the Arms Act at Police Station Patel Nagar, New Delhi.

The nominal roll from the jail has been received. According to the nominal roll dated 09.11.2024, the petitioner has been granted interim bail three times, from 12.06.2020 to 24.06.2020, from 16.09.2021 to 07.07.2022 and from 05.07.2023 to 16.07.2023 and there is nothing on record to suggest that the earlier interim bail was misused at any point. Although the prosecution has found the medical documents to be genuine, the learned APP has submitted that there are other family members who can care for the ailing mother. It has also been submitted that the allegations against the petitioner are serious in nature, and the eyewitness has not yet been examined. The learned APP submits that if the petitioner is released on bail, he may threaten or intimidate the witness. Furthermore, the learned APP further submitted that there is no fixed date for the surgery. However, the learned counsel for the petitioner submits at the bar that the surgery is now scheduled for 14.11.2024.

The petitioner has previously been granted interim bail three times. The medical documents have been verified and found to be genuine. An unsubstantiated assumption that the petitioner may threaten witnesses cannot be a valid ground for denying interim bail due to his mother's illness. Considering the facts and circumstances, the petitioner is granted interim bail for a period of four weeks, subject to furnishing a personal bond of Rs. 15,000/- with one surety of the like amount to the satisfaction of the concerned learned trial court, verification of address, and providing his mobile number(s), in addition to the following further conditions:
a) the petitioner shall not directly or indirectly make any inducement, threat, intimidate or tamper with any person acquainted with the facts of the case;
b) the petitioner shall remain available all the time on the verified address and shall not leave the GNCT of Delhi; The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
c) the petitioner shall further remain available on the mobile number provided and shall contact the investigation officer on every Friday at 5 p.m. through mobile phone.
4. With the above directions, the application is disposed of.
