O R D E R

By way of present application, the applicant seeks anticipatory bail in FIR No.371/2024 registered under Sections 419/420/467/468/471/120-B/34 IPC at P.S. Tilak Nagar, Delhi.

Learned for the applicant submits that in pursuance of the interim protection granted to him vide order dated 15.10.2024, he has joined the investigation and has not misused the concessions so granted. He further submits that the applicant has no role to play in the present case as he was only an occupant of the property in question and subsequently, vacated the property and handed over the possession to Shri Umesh and Smt. Kavita. He also submits that the allegations of forgery are against the co-accused persons and the applicant has no role to play in the same as he has neither executed nor witnessed the relevant documents. applicant has also initiated civil proceedings under Section 6 of the Specific Relief Act for recovery of the possession of the said property. 3.

Learned APP for the State, duly assisted by learned counsel for the complainant, has opposed the bail application. Learned APP submits that the applicant was the occupant of the subject property for the last 40 years and in pursuance of a conspiracy, in which one Mohit has impersonated one Rajat Nanda, executed the Sale Deed in favour of Smt. Kavita. He further submits that the statements of neighbours, Harjeet Singh and Deepak Chopra have also been recorded, who stated that they have come to know from Umesh that the applicant was paid a sum of Rs.80,00,000/- for vacating the said property. He, however, on instructions, submits that there is no material in support of the said allegations except the oral statements of the neighbours.

Keeping in view the aforesaid facts and circumstances, without commenting further on the merits of the case, and considering that the applicant has already joined the investigation and the further fact that the allegations of forgery of Sale Deed are qua the co-accused only and also considering the role assigned to the present applicant, the interim protection granted to the applicant vide order dated 15.10.2024 is made absolute and it is directed that in the event of arrest, the applicant be released on bail subject to his furnishing a personal bond in the sum of ₹25,000/- with one surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:- The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(i) At the time of furnishing bail bond, the applicant shall provide the mobile number, which he undertakes to keep operational at all times during the pendency of the trial. (ii) The applicant shall join the investigation as and when asked.

(iii) The applicant shall inform the concerned Investigating Officer about his current residential address. (iv) In case of change of residential addresses/contact details, the applicant shall promptly inform the same to the concerned Investigating Officer/SHO.

(v) The applicant shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.

(vi) The applicant shall regularly appear before the trial Court.

The application is disposed of in the above terms. 6.

Needless to state that nothing observed hereinabove shall amount to an expression on the merits of the case and shall not have a bearing on the trial of the case as the same has been expressed only for the purpose of the disposal of the present bail application.
