Petitioner seeks initiation of contempt proceedings against the respondents/contemnors claiming that there is no requisite compliance of order dated 11.09.2024 passed by learned Coordinate Bench of this Court in W.P.(C) 12713/2024.

During course of the consideration, learned counsel for the petitioner submitted that the petitioner was having three properties and he had already secured the possession of two properties in terms of the directions given by the Divisional Commissioner. 3.

It is informed that the petitioner has now also got the possession of the third property as well, which is measuring 150 square yards and is located in Khasra No.332/80.

The grievance raised in the present petition is, however, to the effect that as per the order passed by the Divisional Commissioner/District Magistrate (East), the SHO of PS Mayur Vihar had been directed to depute a Beat Constable to visit the applicant as and when required and also on a weekly basis for the next three months, in order to ensure that the order issued by the Tribunal are strictly complied with.

It is submitted that though the possession has been restored, but fact remains that there is no visit of the Beat Constable. 6.

Learned counsel for the respondents, on instructions, submits that there was never any intent to disobey the above said specific directions. During course of the arguments, it is undertaken that the Beat Constable would visit the premises of the applicant as and when required and also on a weekly basis for a period of three months to be reckoned from today, in terms of the order passed by the learned District Magistrate.

Learned counsel for the petitioner submits that in view of the above assurance, he is left with no grievance. He, therefore, submits that he does not press the present contempt petition. 8.

The petition is, accordingly, disposed of as not pressed.
