% 15.10.2024 CRL.M.A. 30899/2024 Exemption granted, subject to just exceptions. The application stands disposed of.

CRL.M.C. 8082/2024 By way of the present petition filed under Article 227 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks a direction to the learned ACMM (North-West), Rohini Court, Delhi, to pronounce orders on charge, that were reserved on 12.01.2024.

Mr. Yogesh Goel, learned counsel appearing for the petitioner submits, that charges were framed in the matter vide order dated 26.03.2022; which order was set-aside vide order dated 17.03.2023 made in CRL REV P. No. 127/2022 and the matter was remanded back to the learned Magistrate, with a direction to decide the matter afresh after giving due opportunity of hearing to the accused and the complainant. Counsel submits that upon remand, arguments on charge were heard by the learned ACMM on 12.01.2024, on which date the court directed that the matter be listed for clarifications, if any, and failing that for orders on 14.03.2024.

Counsel further submits, that the matter has been pending at the same stage since 12.01.2024 and several dates have gone-by in the meantime.

Mr. Goel points-out that the matter was adjourned from 12.01.2024 to 14.03.2024; and thereafter to 22.06.2024, on which date the learned ACJM had placed the matter for orders on 06.07.2024 at 04:00 p.m. However, the matter was thereafter again posted to 12.08.2024 for the said purpose but orders have still not been pronounced. 6.

Counsel states that on 25.09.2024 bailable warrants were issued against the accused/respondent no.2 and the matter has now been posted to 28.11.2024.

Considering the limited nature of the prayers made, and circumstances as explained by Mr. Goel (complainant before the learned ACMM), and fully appreciating the heavy workload and resource constraints of the learned ACJM, the learned ACJM is requested to pass orders on charge within the next 02 months.

The petition is accordingly disposed-of without issuing notice. 9.
