Counsel for the defendant no.1 submits that he has no objection if a decree of permanent injunction is passed in favour of the plaintiffs. 2.

Since there is no contest to the suit, the suit is decreed in favour of the plaintiff in terms of prayer Clauses 59 (i), (ii), (iii) and (iv) of the plaint. Insofar as the relief of delivery-up sought in prayer clause (ix) is concerned, the defendant no.1 is directed to hand over the infringing materials seized by the Local Commissioner to the plaintiffs' representatives. 3.

The plaintiff does not press for the remaining reliefs sought in the plaint qua the defendant no.1.

Decree sheet be drawn up accordingly.

In view of the fact that the suit has been decreed at an initial stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees CS(COMM) 898/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
