Mr. Anunaya Mehta, learned counsel appearing for the respondent informs the court that the parties have signed a Settlement Agreement dated 20.08.2025; under which agreement the possession of the suit property has been handed-back to the respondent, in the execution proceedings. The appellant confirms that he has signed the settlement agreement and that he undertakes to remain bound by the terms thereof.

The appellant has been identified by learned counsel for the respondent since the counsel for the appellant is not available today. His credentials have also been verified through his Aadhaar Card. A copy of the settlement agreement; and a photocopy of the Aadhaar Card have been handed-up in court. The same are taken on record. 5.

In view of the above, the appellant states that he wishes to withdraw the present appeal as per terms contained in Settlement Agreement dated 20.08.2025.

The appellant also requests that the court fee affixed on the memo of appeal be refunded to him.

In view of section 16-A of Court Fees Act 1860 (as applicable to Delhi), 50% of the court fee affixed on the memo of appeal is directed to be refunded to the appellant within 02 weeks of approaching the Registry in this regard.

The Registry is directed to draw-up the requisite certificate in favour of the appellant for refund of the court fees. 9.

Accordingly, the appeal is disposed-of as withdrawn, holding the parties bound by the terms of the settlement. 10.

Pending applications, if any, also stand disposed-of.
