This is a petition under Section 11(6) of the Arbitration & Conciliation Act seeking appointment of an Arbitrator to adjudicate the disputes which have arisen between the parties under the contract dated 03.04.2023 awarded by the Respondent for restoration and rejuvenation of the Yamuna river floodplain at Qudsia Ghat (Waziarabad Barrage to old Iron Bridge, Delhi), SH: Development of Lawn, plantation of trees and shrubs etc at site.

Disputes arose between the parties regarding the payment of certain outstanding amounts to the Petitioner and the Petitioner invoked Clause 25 of the agreement which provides for constitution of Dispute Resolution The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Committee (DRC) before arbitration can be invoked. 3.

Learned Counsel for the Respondent/DDA very fairly submits that efforts can be taken to resolve the disputes amicably, failing which it would always be open for the Petitioner to approach this Court for appointment of an Arbitrator.

In view of the suggestion given by the learned Counsel for the Respondent, this Court is inclined to dispose of this petition with liberty to the Petitioner to approach this Court once again in case the procedure of DRC as contemplated in Clause 25 of the agreement fails. 5.

Learned Counsel for the Petitioner states that procedure of DRC as contemplated in Clause 25 of the agreement has been followed and letters have been written for invoking dispute resolution clause. However, in view of the statement made by the learned Counsel for the Respondent, this Court permits the parties to make fresh efforts to amicably resolve the disputes. 6.

Liberty is granted to the Petitioner to approach this Court once again in case the attempt to amicably resolve the disputes fails. 7.

With these observations, the petition is disposed of along with pending application(s), if any.
