Petitioner/defendant has assailed order dated 10.07.2025 of learned trial court, whereby the amendment application was dismissed, holding that the petitioner/defendant was not diligent and brought the amendment application after five years, when the trial had already commenced, so hit by the proviso to Order VI Rule 17 CPC.

After addressing partly, learned counsel for petitioner after instructions of his client seeks permission to withdraw this petition with liberty to initiate appropriate legal proceedings in accordance with law. 3.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
