This suit was instituted by the Plaintiffs inter alia seeking a decree of permanent injunction restraining the Defendant and all others acting on his behalf from manufacturing, trading, supplying, selling, marketing, in any manner, including online sale or dealing in any other way in any product, including two wheeler spare parts along with packaging material under Plaintiff No. 1's HERO trademarks, including their variants, amounting to infringement of the trademarks and/or passing off. 2.

During the pendency of the suit, parties were referred for mediation before the Delhi High Court Mediation and Conciliation Centre, where they have amicably settled their inter se disputes and executed and signed the Settlement Agreement dated 25.03.2026, incorporating the terms of settlement, whereby Defendant has acknowledged the proprietary rights of CS(COMM) 1002/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the Plaintiffs in the HERO trademarks and has also agreed and undertaken not to use the impugned marks and/or any other mark identical/deceptively similar to Plaintiffs' HERO trademarks. It is also agreed that Defendant shall pay a total sum of Rs. 2,50,000/- to the Plaintiffs in full and final settlement towards cost, expenses, compensation etc., out of which Rs. 99,998/- has been paid at the time of signing the Settlement Agreement and the balance sum of Rs. 1,50,002/- was to be paid at the time of hearing before the Court.

Defendant is present in Court and submits that balance sum of Rs. 1,50,002/- will be paid within five weeks from today as he is unable to arrange for money immediately. Counsel for Plaintiffs, on instructions, has no objection to further time being granted to the Defendant for balance payment and submits that the suit be decreed in terms of the settlement. 4.

Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this suit is decreed in terms of this settlement recorded in the Settlement Agreement dated 25.03.2026. The Settlement Agreement shall form a part of the decree and bind the parties thereto. Defendant is granted a period of five weeks from today for payment of Rs. 1,50,002/- to the Plaintiff, as undertaken. Affidavit of undertaking shall be filed within one week from today.

Registry is directed to draw up the Decree Sheet. 6.

Suit stands disposed of along with the pending application.
