% 05.05.2025 CRL.M.A.13893/2025 By way of the present application filed under section 485 read with section 528 of Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner/applicant seeks modification of the condition imposed vide para 28.1 of order dated 02.05.2025 granting regular bail to the petitioner, to the limited extent that the petitioner may be allowed to furnish one of the sureties from other than a family member. 2.

Mr. Kumar Vaibhaw, learned counsel appearing for the petitioner submits, that since the petitioner is a native of West Bengal and his wife is also an accused in the subject FIR, he is in a position to only furnish one surety from his family member i.e., through his daughter; however, insofar as the second surety is concerned, the petitioner has produced one Ms. Manisha, who is a resident of Delhi and a close family friend of the petitioner. petitioner has not been able to produce any documents proving his familial relationship with Ms. Manisha, the learned trial court has rejected the second surety produced by the petitioner. 3.

In the above circumstances, Mr. Vaibhaw seeks that the court may modify the condition as contained in para 28.1, permitting the petitioner to furnish his second surety through Ms. Manisha. 4.

Given the nature of prayers made by way of the present application, it is not considered necessary to issue notice to the Respondent/State. 5.

Keeping in mind the submissions put-forth by Mr. Vaibhaw, order dated 02.05.2025 is modified to the limited extent that para 28.1 of the said order would now stand modified to read as follows: 28.1. The petitioner shall furnish a personal bond in the sum of Rs.10,00,000/- (Rupees Ten Lacs Only) with 02 sureties in the like amount, at least one of which must be from a family member, subject to the satisfaction of the learned trial court; 6.

No other modification is being made in order dated 02.05.2025. 7.

Mr. Vaibhaw informs the court that the credentials of Ms. Manisha already stand verified. If that be so, the learned trial court may pass requisite instructions for release of the petitioner. 8.

Application stands disposed-of in the above terms. 9.

Petition already stood disposed-of vide order dated 02.05.2025.

10. A copy of this order be given dasti under the signatures of the Court Master.
